"The Trustee’s legal counsel had been in discussion with the Guarantor’s legal counsel in order (among other things) to attempt to agree an extension of the Election Deadline for Noteholders and the Trustee also petitioned 7th Corporate Court of the Capital District of the State of Rio de Janeiro (the Court) to, among other things, seek an extension of the Election Deadline.
NOTICE IS HEREBY GIVEN to Noteholders that the Court has issued a judgement in which (among other things) the Court has:
(i) approved an extension of the Election Deadline to 8 March, 2018; and
(ii) ruled that the Trustee has the right to make a Recovery Election under the RJ Plan on behalf of Noteholders who have not already individualised their claims.
Noteholders should be aware that the Court’s judgement does not provide detail on the Trustee’s right to make Recovery Elections under the RJ Plan on behalf of Noteholders and, in particular, does not make clear the process by which the Trustee could make such an election on behalf of Noteholders. That aspect of the Court’s judgement may also be subject to challenge and/or appeal from other creditors of the Guarantor (or the Guarantor itself)
The Trustee is considering that aspect of the Court’s judgement, but Noteholders who have not already individualised their claims should not assume that the Trustee will be in a position to make a Recovery Election on their behalf. Therefore, the Trustee suggests that Noteholders who which to make a Recovery Election under the RJ Plan and have not already done so should make arrangements to make a Recovery Election on or before the extended Election Deadline.
Noteholders are reminded that that, if they do not make a Recovery Election under the RJ Plan, they will be subject to General Payment Method provided for under section 4.3.6 of the RJ Plan which provides, among other things, for a 20 year grace period for payments of claims by the Guarantor. Noteholders are also reminded that details as to how they can individualise their claims and/or make Recovery Elections under the RJ Plan are set out in the various notices and Q&A documents which are available on the Guarantor’s website (located at http://www.recjud.com.br)."
